By purchasing products from Black Matter, manufactured by Benjamin Black Limited, the customer agrees to the following terms and conditions of sale.
GST (Goods and Services Tax)
For New Zealand delivery addresses, all prices are New Zealand GST (Goods and Services Tax at 15%) inclusive unless otherwise stated. If your order ships to a delivery address outside New Zealand, no GST will be charged.
Orders over $500 NZD within Australia and New Zealand qualify for Free Shipping.

- Australia: (0.0 kg – 25.0 kg) = $20.00 NZD
- UK/Europe: (0.0 kg – 0.5 kg) = $49.00 NZD
- United States: (0.0 kg – 0.5 kg) = $42.00 NZD
- Asia: (0.0 kg – 0.5 kg) = $35.00 NZD
- Rest of the world: (0.0 kg – 0.5 kg) = $82.00 NZD
Customs and duties
For any orders shipped to an address outside of New Zealand the customer is the importer of record and will be responsible for all customs import duties and any local sales tax charges. These charges vary in each country and are outside of Black Matter’s control. Contact your local customs office for more information on what import duties or sales taxes may be imposed.
Please note: Due to the Covid-19 lockdown, your order will be shipped once level 4 restrictions have been downgraded in New Zealand.
All orders sent within New Zealand are targeted for delivery between 3 and 5 working days. Orders shipped outside of New Zealand normally take up to 10 working days.
Black Matter makes every effort practical to ensure that delivery timeframes given are accurate. However, the estimated delivery times assume no unforeseen events. By placing an order, you agree not to hold Black Matter liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimated time frame.
Please contact your insurance company to have your Black Matter jewellery insured before your jewellery leaves Black Matter’s premises as your jewellery is not insured by Black Matter once it leaves Black Matter’s premises. We can organise independent registered valuations on your behalf to assist in ensuring your jewellery is insured for the correct value.
If an order/s is found to be incorrectly addressed by Black Matter then Black Matter will be responsible for the re-delivery, replacement or refunding of the item(s). If the customer is found to have given an incorrect or insufficient address, Black Matter will not refund or resend the product. All responsibility and associated costs for correcting delivery will be borne by you.
1. Returns on stock jewellery i.e. directly purchased from the Benjamin Black store:
If you are not satisfied with the items you have ordered, please email us and let us know the reasons for your dissatisfaction. If you return your order to us within ten days of receipt, unused, with the goods undamaged and in their original packaging, we will be happy to offer a full refund or exchange the goods for other items.
- We will only accept goods returned with prior notification within ten days of receipt through correspondence with our sales team.
- All returned goods must be sent to Black Matter’s premises.
- The original invoice/receipt must accompany the returned item.
- We can only accept items returned if they are within the original packaging.
- Courier/airmail and/or credit card charges will not be refunded.
- We strongly advise all customers to check goods thoroughly upon delivery.
2. Returns on custom made jewellery i.e. jewellery made to individual order:
If you are not satisfied with the items you have ordered, please email us and let us know the reasons for your dissatisfaction.
Due to the individual needs of each client, and personalisation that goes into the creation of a custom made piece, we cannot guarantee a full refund on a custom made product. However, we will work with you to try and arrive at an amicable solution in accordance with our terms and conditions and New Zealand Law.
Receiving a refund:
Once your order has been returned to us within the above stated time frame, and if agreed to by Black Matter, we will begin to process your refund request. Each item will undergo a quality control check and once verified, your refund will be processed in the original payment format as your purchase was made within 30 days of the date of cancellation notice. All undamaged, correctly returned products will be credited to the original purchaser’s bank account, including GST where applicable. Please note that your bank institution may require additional days to process and post the transaction to your account once they have received the information from Black Matter.
Further, only items which Black Matter can confirm as new and unused will be eligible for a refund or exchange, so that they have reached our returns department within the time frame outlined above, unless otherwise arranged with and agreed to by Black Matter. If we receive your returned goods in a condition which we consider is not fit for exchange or refund we shall get in touch with you. Benjamin Black reserves the right to refuse a refund for any item sent back in a condition where the item has been used or damaged.
Black Matter’s liability for any loss or damage of any kind arising from the supply of goods or services is limited to the price paid for the goods or services. You shall indemnify Black Matter against all claims and losses of any kind whatsoever that has any correlation to the supply of or provision of any goods or services.
New Zealand law
All goods or services supplied or sold by Black Matter, are subject to the laws of New Zealand. The laws of any other country shall not apply between you and Black Matter.
Where the provisions of the Consumer Guarantees Act 1993 apply, these terms will be read subject to the application of that Act, and in the case of any conflict, the provisions of that Act will apply.
The Consumer Guarantees Act 1993 does not apply to business customers (where “business” is as defined by the Act). Business customers agree that where products are purchased for the purpose of a business that the Act does not apply.
